Statement Regarding the Patent Infringement Lawsuit

Shanghai Aiko Solar Energy Co., Ltd. (hereinafter referred to as “AIKO”) received a patent infringement lawsuit filed by Maxeon Solar Technologies, Ltd. (hereinafter referred to as “Maxeon Solar”) at the Unified Patent Court (UPC) in Europe concerning a European patent. In response, we state the following:

As a global leader in new energy technology, AIKO places a high value on intellectual property and independent research and development, insisting on technological innovation to drive industry growth. As of May 31, 2024, the company has filed a total of 2,100 patents, including 430 patents related to ABC technology, and has been granted 1,220 patents.

Maxeon Solar claims in its filing that AIKO’s products infringe on its EP3065184B1 patent. This patent was granted on March 13, 2024, and is a family patent of EP2297788B1, which was asserted in a preliminary injunction request that was dismissed by a Dutch court.

We now had the chance to study the statement of complaint from Maxeon Solar, which confirmed the conviction of AIKO’s intellectual property team and our collaborating European intellectual property law firm that AIKO’s ABC products are markedly different from the technology covered by the EP3065184B1 patent and do not infringe upon this patent.

In response to this lawsuit, the company will actively defend itself and work closely with our global partners to jointly protect our legitimate rights. In accordance with the principles of integrity and transparency, the company will promptly disclose the progress of this lawsuit.
