AIKO statement on patent infringement claims noticed by the Company

[Dusseldorf, 16 November 2023] — AIKO, a leading provider of sustainable energy solutions, has made the following statement after becoming aware that a subsidiary of Maxeon Solar Technologies, Ltd. has filed a patent infringement complaint against AIKO entities before the Mannheim Regional Court, Germany.

As a world-leading new energy technology company, AIKO has been relentless in developing cutting-edge technology and leading the industry with innovation by attaching great importance to intellectual property rights and adhering to independent innovation. As of October 31, 2023, the company has applied for a total of 1,882 patents and obtained 1,061 granted patents, including 325 patents applied for ABC (All Back Contact) technology, among which 157 have been granted, forming a complete protection system for our products.

The complaint has not yet been served on AIKO, and we do not yet know its exact content. According to the information provided on Maxeon’s website, they claim that AIKO’s products infringe their European Patent EP 2 297 788. AIKO’s ABC products are fundamentally different from the technology protected by the asserted patent, as has been confirmed by our intellectual property team and our European outside counsel, a renowned IP firm.     

We intend to robustly defend our position with our partners while jointly and actively seeking a resolution to defend our legitimate rights and interests, retaining the right to pursue further proceedings.
