1. Scope

1.1

These terms and conditions (“T&C) apply to European photovoltaic installers (“Installers”; as described in section 2.3. below) that participate in the AIKO Installer Community (“AIC”; as described in section 2.1. below) program that is organized by AIKO Energy Germany GmbH (“AIKO”).

1.2

By entering the AIC program each participant (“Participant”) accepts these T&C together with any specific instructions and terms related to the program which may be mentioned in any electronic messages, or on the website, or communicated in any other way (“AIC Information”). Such AIC Information shall prevail in the event of there being any inconsistency between these terms and conditions and any AIC information.

1.3

The AIC program starts on 01 May 2024 and lasts indefinitely. AIKO reserves the right to amend, suspend, or terminate the program, these T&C, or any AIC-related information at any time without prior notice. Relevant changes will be published simultaneously within these T&C and on official AIC communication channels, including social media and the AIC website (https://aikosolar.com/en/installer-community). The AIC program is operated in accordance with applicable EU consumer protection and data protection regulations, including the General Data Protection Regulation (GDPR). Localized versions of these T&C will be made available in the official languages of each market where AIKO operates.

3.3

AIKO will send a notification email to the Participants after their successful registration via their given email address. If AIKO is unable to notify, and such is attributable to the Participant (e.g. wrongful or missing contact details), this may result in forfeiture of the Gift, without any further title for the Participant.

3.4

AIKO may in its sole discretion refuse to provide a Gift, or seek its recovery, in the event of non-entitlement under these terms or a Participant’s breach of these T&C, AIKO website terms of use, fraud, dishonesty, or other inappropriate or improper conduct including but not limited to the use of technology which enables an entrant to evade charges or entry requirements.

Any Participant who enters or attempts to enter the AIC program in a manner, which in AIKO’s determination, is contrary to these terms and conditions or by its nature is unfair to other entrants may be removed from the Competition at AIKO’s sole discretion. Confirmed violations will result in Point cancellation and permanent suspension. AIKO reserves the right to pursue legal action against fraudulent behavior.

3.6

AIKO reserves the right to modify, cancel, terminate or suspend the AIC program in whole or in part, at its sole discretion, in cases of force majeure and/or if it believes the Competition is not capable of being conducted as specified in these T&C or in the event of a virus, computer bug or unauthorized human intervention or any other cause that is beyond the reasonable control of AIKO that could corrupt or affect the administration, security, impartiality, or normal course of the Competition.

3.8

Gifts will only be granted as stated: there is no entitlement to payment of the Gift. If one specified Gift is not available, AIKO will provide the qualified Participant with a similar Gift of corresponding value.
